1. Introduction
These Terms of Service ("Terms") govern your access to and use of ExamPath ("Service"), an AI-powered exam preparation platform operated by KLINICA SOFTWARE SOLUTIONS S.R.L., a company registered in Romania (CUI: RO45227020) ("Company", "we", "us").
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 16 years old to use ExamPath. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
3. Account Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately at support@klinica.io if you suspect unauthorized access.
4. Service Description
ExamPath provides AI-powered study tools including:
- AI Tutor — conversational learning assistant based on your uploaded course materials
- AI Practice Tests — auto-generated exams with AI grading
- Smart Schedules — AI-generated personalized study plans
- Material Upload — indexing of textbooks, slides, and notes
All AI-generated content is provided for educational purposes only and may contain errors. You should not rely on it as the sole source of information for academic decisions.
5. Credits and Billing
5.1 Credit System
The Service operates on a credit-based system. AI interactions consume credits as follows:

5.3 Billing Terms
- Paid subscriptions are billed monthly in advance via Stripe.
- Credits do not roll over between billing periods.
- New accounts receive a one-time welcome bonus of 200 credits, valid for 30 days.
- When your credits are exhausted, AI-powered features become unavailable until your next billing cycle or a plan upgrade.
- All prices are in USD and exclude applicable taxes.
5.4 Cancellation and Refunds
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
- No prorated refunds are provided for partial billing periods.
- Upon cancellation, your account reverts to the Free tier.
- We reserve the right to offer refunds at our sole discretion on a case-by-case basis.
6. Intellectual Property
6.1 Your Content
You retain ownership of all materials you upload to ExamPath ("User Content"). By uploading, you grant us a limited, non-exclusive license to process, index, and use your User Content solely to provide the Service to you.
6.2 AI-Generated Content
Content generated by the AI (practice tests, schedules, tutor responses) is provided to you for personal educational use. You may use AI-generated content for your own study purposes. We make no claim of ownership over AI-generated outputs specific to your materials.
6.3 Our Platform
The ExamPath platform, including its design, code, algorithms, and branding, is the intellectual property of KLINICA SOFTWARE SOLUTIONS S.R.L. and is protected by applicable copyright and trademark laws.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Upload content that infringes third-party intellectual property rights
- Attempt to reverse-engineer, decompile, or extract the AI models or algorithms
- Use automated tools (bots, scrapers) to access the Service
- Share your account credentials with others
- Resell, redistribute, or commercially exploit AI-generated content
- Attempt to circumvent credit limits or usage restrictions
- Upload malicious files or content designed to exploit the system

8. Account Suspension and Termination
- We may suspend or terminate your account if you violate these Terms or the Acceptable Use Policy.
- We may suspend accounts with suspicious activity pending investigation.
- Upon termination, your right to use the Service ceases immediately.
- We will make reasonable efforts to allow you to export your data before deletion, unless termination is due to abuse.
9. Disclaimers
- The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
- AI-generated content may be inaccurate, incomplete, or outdated. We do not guarantee academic results.
- We do not guarantee uninterrupted or error-free operation of the Service.
- We are not responsible for the accuracy of content you upload.
10. Limitation of Liability
To the maximum extent permitted by applicable law, KLINICA SOFTWARE SOLUTIONS S.R.L. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, academic outcomes, or profits, arising from your use of the Service.
Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Analytics
We use Mixpanel, a third-party analytics service, to collect anonymized usage data and understand how users interact with the Service. Mixpanel helps us improve features, identify issues, and enhance the user experience. Analytics data is collected only when you accept cookies via the consent banner. 12. Data Protection
We process personal data in accordance with our Privacy Policy and applicable data protection laws, including the EU General Data Protection Regulation (GDPR). As a Romanian company, we are subject to EU data protection requirements.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
14. Governing Law and Disputes
These Terms are governed by the laws of Romania. Any disputes shall be resolved by the competent courts in Bucharest, Romania, unless mandatory consumer protection laws in your jurisdiction provide otherwise.
